《外商投资电影院暂行规定》的补充规定

　　The following supplementary² provisions on issues concerning investment in cinemas by Hong Kong and Macao service providers in the Foreign Investment in Cinemas Tentative Provisions （State Administration of Radio， Film and Television， Ministry³ of Commerce and Ministry of Culture Order No. 21） and the annex⁴ are hereby formulated⁵ in accordance with the Supplementary Agreement to the and the Supplementary Protocol⁶ to the approved by the State Council， in order to promote the development of economic and trade relationship between the mainland and Hong Kong and Macao and to encourage Hong Kong and Macao service providers to establish enterprises that engage in film screening business in the mainland：

　　1. Beginning from 1 January 2005， Hong Kong and Macao service providers are permitted to build， renovate⁷ and operate cinemas in the mainland in the form of equity⁸ or cooperative joint⁹ ventures or wholly-owned enterprises.

　　2. “Hong Kong and Macao service providers” specified¹⁰ in these Provisions shall satisfy the definition of “service provider” and the requirements of the relevant provisions in the Mainland/Hong Kong Closer Economic Partnership¹¹ Arrangement and the Mainland/Macao Closer Economic Partnership Arrangement respectively.

　　3. Other provisions on investment in cinemas in the mainland by Hong Kong and Macao service providers shall still be implemented¹² according to the Foreign Investment in Cinemas Tentative Provisions.

　　4. These Provisions shall be implemented as of 8 May 2005.
