The people's right to sue government agencies and officials should be protected by the introduction of more detailed¹ rules, according to a draft amendment² to the Administrative³ Procedure Law.

 

行政诉讼法修正案草案指出，要出台更多细则来保护公民起诉政府机关及其工作人员的权利。

 

此次提交全国人大常委会审议的行政诉讼法修正案草案（draft amendment to the Administrative Procedure Law）是该法施行23年以来的首次修改。行政诉讼法（Administrative Procedure Law）是为了规范和保障人民法院能够正确、及时的审理行政案件（administrative lawsuits），保护公民、法人和其他组织的合法权益（lawful rights and interests），维护和监督行政机关依法行使行政职权，从而根据宪法的规定制定的一部程序性法律。

 

此次提交审议的修正案草案扩大了法院受案范围，拟规定，行政机关侵犯公民、法人等依法享有的土地、矿藏、水流、森林、山岭、草原等自然资源的所有权或使用权（government agencies infringing⁴ their rights of owning or using natural resources, including land, minerals, water, forestry⁵, mountains and grassland）等案件，法院应当受理。

 

此外，行政机关违法集资（illegal financing)、征收征用财产（illegal property requisition）、摊派费用（illegal cost apportionment），行政机关没有依法支付最低生活保障待遇或者社会保险待遇（failing to pay minimum living allowance or social insurance benefits）等，也将被纳入法院受案范围。
